Well everyone after getting a pm from JB I decided to take some action! I called paypal long story short they told me to fly a kite! It was sent as a gift an there was no way of filing a despute for a gift. Guess I didnt get the good helpful operator! The only advice she gave me was to call my credit company! So i did an 5 minutes later with minimal bs she told me my account would have a credit posted for the total amount! Will see what happens !!!

I used personal payment, goods, paid fees, and so when I called paapaa they were cordial and dealt with me.  They asked what it was for and I just said "items, collectibles" and it was squared away.  Unless he ships and sends a confirmation number, 11 days refund. 

Thanks guy for all the help on this who figured it out.  Surely makes an annoying situation merely sad....

The final outcome of this situation, and the fact that some people who paid using the gift option, may lose their money because of that, should be a great example to others at OLH down the road who decide to use that same means of payment within PP.

I rarely use the gift option, unless its somone I know well, or have dealt with before a couple times and feel 100% sure the deal will be whole.  Otherwise I just pay with the goods option, and add 3.5% to the total payment.  In this case, the seller gets a little extra, and at least you are covered if something happens with the deal.  Its great to hear that PP is helping most people involved here.

I will never use it again (gift option). The other thing that sucks is the fact Diesel had no bad comments in his profile up until this. How do you know in the future if someone is of the same mindset ? I'm not out a ton of scratch but it pisses me off when someone just takes advantage of trusting people like this. here's to you Ron :finger:

P,,, p,,, said the same thing to me, but i used a my back acct and they told me also that there was nothing they could do sing it was gift and paypal is directly authorized by me to draw funds from there was no fraud,  for me it was only 40$ and in the end a cheap lesson compared to some other people of those that did get taken for alot email me and if i have something that was what you were looking for ill ship it to you, a lil way to share the pain

You don't.  People are call "con men" because "con" is an abbreviation of "confidence".  The idea is to gain your confidence, then take you to the cleaners.

Now, I've no idea if this guy planned it all along (make no mistake, a number of people do), or if he's just a tweaker who relapsed.

But either way, there's a reason why people tend to prefer buying and selling to/from people they've known personally for a long time.

I got no dog in this fight, and I am sad to see others losing money out on this deal. While some did buy pipe tobacco, I'd be weary of going to the police if ya were buying cuban cigars, which we all know are illegal here in the States. Might not look so good if they ask ya what ya bought to get scammed and ya say cigars, or possibly cuban cigars when they ask ya for more details. Then ya may be looking at some trouble for yourself rather than the guy that scammed ya.

Hope in the upcoming days things get resolved for ya'll. Maybe he comes to his senses and or gets better if he's in some trouble and makes good on everyone's purchases.
