FWIW - I've traded with Tbone many times and never had an issue at all. I don't want this to reflect poorly on him.
As far as how to handle the situation. I got nothin' but a hope that it works out well for everyone involved.

If this were ebay, the seller compleated his part of the transaction with a confirmed delivery. The buyer would be SOL. If I trusted the buyer, I would go to a B&M and get a receipt for what was shipped and make everyone whole. IMO you have done nothing wrong and should not have to give a refund. In this economy there are plenty of people who are running scams. My action would be based on how well I knew the buyer and his rep in the cigar world.

This is stange. I insure every pack but when sending random sticks or a bomb who would have a receipt? ???
I have been burned on the insurance before. They asked for a receipt of a damaged item. I had no receipt but it was obvious they damaged the package and item. Their investigation was NO RECEIPT, NO INSURANCE even tho I paid for the insurance. No refund for item w/o a receipt of what you paid for it. Wait til you put in a claim for anything w/o a receipt. How can they pay you and if lost, how can they pay for something that they do not know was in the box if lost. Then it would open up to a lot of claims and cost would be outrageous.

I keep my receipts until I know the package was received and in good condition... but as far as a claim goes, its very difficult to prove what was lost in the claim. Besides, who actually takes pictures of whats's in the box before its sent ?? The USPS can be difficult to deal with, but still not as bad as UPS. Thankfully, I have never had to file a claim for lost or damaged cigars.

First off Tuck, I'm sorry for you, this sucks!
This has happened to me three times as a seller (only once with cigars). The fact is that the delivery man is supposed to only scan the DC when the package is being brought to the door/mailbox. But sometimes they jump the gun. I have had packages that were being delivered TO ME that said "Delivered" on the website 1-2 days before the packages showed up (and in one case, it never showed up). These were all while I was living in your neck of the woods.
In the instances where I was the seller, once they were delivered to a nice neighbor who brought the package to the guy (phew), and the other two times nothing. In one case I suspected the buyer was lying, in the other I suspect it was either lost or stolen by a PO worker (theft within USPS is insanely high, especially for APOs, you wouldn't even believe it!).
So yea, this sucks, but I'm not sure what you can do about it other than wait a little while longer and hope it turns up. I think it's clear the buyer got screwed by USPS in this case, not by you. I don't think their is any need for you to refund or reship.

Understood, never really thought about it before. I think I only sold cigars 1 time but I do ship a lot of stuff out "knock on wood"! I guess I never thought about a receipt and never read the TOS maybe I should have. :-[ I hardly ever buy cigars from a dealer, 90% come from BOTL. Hence my question.
