First off, I am very bummed to write this up. Until now I have considered David a friend/cigar buddy. We have done numerous trades over the years. Phone calls, text messages etc etc. He has helped me out on multiple occasions getting me something that I could not find, and I hope vice-versa.
David and I made an agreement over text message for 3 boxes of cigars(2 opened for insp. and 1 sealed). I paid via PP F&F. He sent the cigars. When they arrived I could hear them moving around inside their boxes. Sure enough when I opened up the 2 opened boxes the cigars were not secured inside the box. They had been sliding and banging around during shipment. They have/had closed feet which had been broken off, a couple broken caps and 3 with cracks around 1/2 way point of the cigar. I immediately text David a photo of the broken tobacco pieces in the bottom of the empty box. Then immediately called David and told him I was super pissed that they had been shipped w/out securing the cigars. Told him I was too pissed at the moment and too busy to immediately figure out a solution but I would get back with him in a day or so after I had time to think it through. This was on a Thursday. On Saturday I reached back out to him with a text looking for resolution. He responded with very much a non answer and no solution. Wednesday I reached out again by text and phone calls. I suggested that I should just send them back to him and he could refund. The following day I get a text “Resell them. Can’t do refund.” This pretty much put me over the edge, asking me to take the responsibility of getting rid of sub standard HTF cigars. Then, he goes dark, not responding to my text messages. He returned a call but hung up before I could switch over. I called him back 4 times(left messages 3 times) since I missed that call and he always sends me to voicemail.
Yesterday I sent him a “last chance” message on OLH. He responds with “I don’t know what to tell you. It’s done with”.
I need to be clear…I am pretty sure David does not have the money right now as he indicated he was liquidating to buy a vehicle. I TOTALLY UNDERSTAND the situation and was totally willing to work through it. I wasn’t demanding an immediate refund with David like I would a newbie or someone I don’t know. However, going dark on me and basically telling me to kick rocks doesn’t fly no matter who you are(let alone telling me to sell the f’d up cigars to someone else).
As of right now, he owes me $400 for a box of f’d up cigars. This is being cross posted on OLH, FB groups, SNS.

The Sns club might be a better route to get something done than here.

Was it a transaction that took place on OLH? There are probably 2 sides to this story and I wouldn't comment on a forum that had no involvement in the issue if I was Kombat. I have received many a gift and splits from Kombat with no issues at all.

It's easy to do the right thing when everything goes okay and bit harder when something unexpected happens. I recently sold a partial box and thought I had the cigars secured in the box but not so much. Cigars got buggered up a bit and that's on me. Seller wanted to keep them and we worked out a partial refund for the damaged (smokeable) singles.
Always hate to see someone lose their good reputation over a few cigars/dollars. If you think it won't affect you here and elsewhere you are mistaken. Time to man up!!

Many a year ago I sold collectible shit on eBay. I sold a guy a vintage cookie jar and mailed it to him in what I thought was the proper was the way to pack it.
Needless to say it arrived crushed. :gotcha:
At first he was pissed but I apologized and refunded his dough and told him I would have done better had I known better. We kind of laughed at my way to kill a bear.
Hope this works out, even though it was me that screwed up, not you giver.

Kind of like... selling a Siglo VI jar, priced like it was full of cigars and not noted empty, buyer gets it smashed, with no cigars, then seller doesn't offer any refund until the hounds got released??
