In 6 years of buying online from multiple places and people, I have NEVER had someone file a claim. They shipped, its on them. If there's ever been damage, they have handled it like a gentleman. Id leave appropriate feedback and move on. Youd think he would offer a refundright away after leaving bags open. And dont buy into the busy excuse. He replied to multiple people and even reached out to me tryin to make a sell because of an ISO I posted.

I don't understand what the status of the insurance claim with USPS has to do with the seller making things right by either replacement or refund (or whatever other equitable arrangement is made with the buyer). ???
That insurance claim is made by the seller (the person filing must have the original mailing receipt). The buyer will need to provide evidence of the damage (i.e. pictures) to the seller (has that happened?). The insurance payment, if any, will be made to the seller. So apart from providing evidence of the damage to the seller, the buyer's role in this transaction is completed and the seller needs to satisfactorily fulfill his end of the transaction.

As soon as USPS finds out it is tobacco, you're out of luck. USPS is not going to pay a dime.

Gotta love the ole, I'll ignore this problem until it goes away, oh shit my name got called out in public so I must reply. Then the public gets to see the attitude and excuses of, you only bought 3 cigars and I'm a busy man, with kids and mouths to feed.
Nice way to make an easy fix that much harder on yourself...
Shipping damage can happen with even well packed cigars, but your packing job was bush-league and you ignored him until called out. That's enough people need to know...
OP, please leave correct feedback regardless of the situation. If he ends up giving you an acceptable resolution, simply add that at the end.

It's good when problems like this come to light, and the community steps up and shows support for another
member who has been wronged, and make no mistake, that's what happened.
This seller will never have the same acceptance in this group, and he has done this to himself by being greedy
and failing to man up and fix the problem he has made.
For myself, I would never trust him in the future under any circumstances.

Completely agree...I have seen his posts and thought prices were a bit high, but if I want something bad enough, I am always willing to pay. I won't open a for sale thread by him ever again. That is why in my first post above, I mentioned honest feedback be left...there are many people who shop here but don't read posts in the BZ, so feedback is their only way of doing pre-buy research.

What resolution are you hoping for? He did a piss pour packing job and is wanting money back from the USPS for it. That should tell you something...
