And that difference is what, may I ask? ???
Fair market value (FMV) is an estimate of the market value of a property, based on what a knowledgeable, willing, and unpressured buyer would probably pay to a knowledgeable, willing, and unpressured seller in the market. An estimate of fair market value may be founded either on precedent or extrapolation. Fair market value differs from the intrinsic value that an individual may place on the same asset based on their own preferences and circumstances
EDIT: also, I do not know where you are from and what the laws are there, but the US is not a completely true free market anyways. There are laws to protect consumers from being taken advantage of in certain ways (from monopolies, etc.; but obviously not every way), patents to protect inventors and assist in innovation, etc.

I see your point but we are talking luxury items versus, say gasoline.

agreed, but the fair market value concept applies to everything. In some cases it applies to cigars selling at above MSRP and in some cases those cigars that are selling above MSRP are just taking advantage of a person who is not knoweledgable (e.g. selling 10 cigars for $250 when, at the exact same time, multiple vendors are selling 15 of that exact same cigar for the same price or cheaper).
tl;dr sometimes selling above what you paid can be fair, sometimes it can be taking advantage of people

We are all grown men here. If you can do a little homework on your own when the internet is at the tip of your fingers then you have NO ONE else to blame but yourself. People are lazy, stupid, or just have so much money they dont give a fuk. Take time to learn a little before you jump into the lion cage. My 2 cents.
Im done caring about what other grown men do with their cigars and their money. Life is to short to fight every internet battle especially when it isnt for you. However I do think we as a group should continue to warn those of scammers and scumbags.

No one can take advantage of you without your permission. If I see a box of cigars that are 30% to 40% over retail and agree to pay that price, whether I am ignorant or not of their real value, that's my agreement with the seller and I would have no one to blame but myself for being screwed.

Re: Gouge Gauge
And you know about retail where?
Cafe Tabac, Toronto, Ontario Canada.
Cohiba Robustos , 25 Box. $910
Puro Express
Bolivar Belicosos Finos, Cabinet (25), $194 always OUT OF STOCK
Many suppliers we all know about, many here do not. Some here sell to each other at cost, BOTL etc. But face it, this site has become an online classified ad store. With the advantage of some insight if the seller is has a history of being crooked or not.
Just saying.
