Because it would be a stupid rule.  How exactly would the site be able to regulate and enforce that as a rule?  It would be impossible.  Insurance has no bearing on this discussion other than it would have saved your ass.  Without you are fucked in a situation like this, enjoy.

Its not a rule because its up to the sender. You could send with or without insurance. Its completely up to sender. But the sender is the one thats responsible for delivery.

Is it possible to be this blatantly irresponsible?  CigarKid when you're on the "list" this will carry over to BOTL also dude.  You're being a complete thief in this situation and you know it.  Quit ripping off Brooklyn and do the right thing.  You can save the bullshit taking that as an insult but if the shoe fits!!!

A thief would be selling him cigars, and not sending them. It's not like I have the cigars in my humidor right now. How does this make me a thief. I wanted to get the cigars back and send him the money, that was the plan, but it didn't work out that way.

Theif - a person who steals, especially secretly or without open force; one guilty of theft or larceny.

This was not the case.

 Not only did he screw up the address and not insure the package but he somehow feels that Brooklyn should share in the blame.  Why should Brooklyn have accepted a partial refund and take a loss on goods that were never delivered and at this point never will be?  What he fails to understand is at this point yes he is a thief and the list follows you everywhere.  It seems to me he thinks the list is just an OLH only thing and that he can just run back to BOTL like this never happened. CigarKid you should make this right and refund his money.  Look at it as an expensive learning experience.  This is the only way you can keep your reputation intact.  Once on the list you'll essentially be blackballed from trading and your name will be dirt across all boards.

Your assumption is that the PO screwed up.  Is the possibility there that since you hand wrote these labels that you screwed up?...that maybe they were unreadable?  (future learning, use USPS Click and Ship and that would have never happened).  You are basing this entire thing on their screw up which is unverifiable.  
Then you screwed up by not buying insurance and that's all on you.  

Ask your favorite B&M how they'd handle this situation.  They mail a box to a customer, it never gets there and never gets returned.  Do they tell the customer "tough cookies"....No, they replace it or refund it.

Even on ebay that excuse is not valid. AS a seller you are responsible to make sure the buyer gets the product.  Getting insurance is the only way to cover your ass. Bottom line, you are in the wrong and if you want your good name intact. You should do the right thing and issue a refund., education is never free/.
